wherein it is mentioned that the petitioner was driving a vehicle Mahendra Bolero which was recovered by the police in an abandoned condition. Learned counsel for the petitioner has submitted that thereafter the police arrested the petitioner and after investigation filed charge-sheet against the petitioner while alleging that the petitioner was driving Mahendra Bolero jeep in which a huge quantity of poppy straw was transported. Learned counsel for the petitioner has submitted that except the informations given by the petitioner in another criminal case in police custody as well as in this case, no other evidence is available on record to connect the petitioner with the commission of crime. It is submitted that the statements of Investigating Officer Sugan Singh (PW-1) have now been recorded before the trial court wherein he has specifically admitted that except the information given by the petitioner in police custody in other criminal case as well as in this case, no other evidence is available on record to connect the petitioner with the commission of crime. Learned counsel for the petitioner has further submitted that the Investigating Officer in his cross-examination has also admitted that during the course of investigation, he did not find any independent witness, who had seen the petitioner purchasing the narcotic contraband or transporting the same. The Investigating Officer has also admitted that in the abandoned vehicle, no document, which connects the petitioner with the commission of crime, was found. Learned counsel for the petitioner has, therefore, submitted that from the above piece of evidence, it is clear that except informations given by the petitioner in police custody in relation to other criminal case as well as in the present
