The present third bail application has been filed under Section 439 of Cr.P.C. on behalf of the petitioner who is in custody in connection with F.I.R. No. 143/2017, Police Station Sri Dungargarh, District Bikaner for the offences under Sections 363, 366 & 376(2)(I) of I.P.C. and Section 3/4 of the POCSO Act.
Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.
Learned counsel for the parties submit that out of 10 prosecution witnesses, 08 have already been examined and only two witnesses need to be examined by the learned trial court.
The trial is at the fag end and therefore, this Court is not inclined to release the petitioner on bail at this stage.
The third bail application is, therefore, dismissed.
