An application (Inward No.01/2019 dated 23.07.2019) has been preferred on behalf of the petitioner seeking withdrawing of the instant bail application filed under Section 439 Cr.P.C. on the ground that the charge-sheet has been filed.
Learned counsel for the petitioner, without arguing the matter on merits, has submitted that after filing of the present criminal misc. bail application, charge-sheet has been filed, therefore, he does not want to press this criminal misc. bail application, however, seeks liberty for the petitioner to file a fresh bail application before the trial court.
In view of the above, the instant criminal misc. bail application preferred on behalf of the petitioner under Section 439 Cr.P.C. is dismissed as withdrawn, however, the petitioner will be at liberty to file a fresh bail application before the trial court.
