Petitioner has filed this third bail application under Section

439 of Cr.P.C.

F.I.R. No.R.C.J.A.I./2017/A/0015 was registered at Police Station SPE:CBI:ACB:Jaipur for offence under Sections 120-B, R/W 409, 420, 467, 468, 471 of I.P.C. and Section 13(2) R/W Section 13(1)(C)(D) of PC Act.

It is contended by counsel for the petitioner that the second bail was rejected on 08.10.2018. Petitioner is in custody from 04.01.2018. C.F.S.L. Report has not been filed, as a result of which statements of witnesses have not been recorded. It is contended that in a similar case, though in a different FIR, this Court granted bail as C.F.S.L. Report has not been produced. It is contended that the allegation in the present case is of causing loss of Post Office to the tune of Rs.15,85,730/-(Fifteen Lakhs, eighty

five thousand and seven hundred thirty). It is contended that there are as many as 34 witnesses, out of which only statements of two witnesses have been recorded. Statements of four witnesses are not yet complete due to absence of record.

Learned counsel appearing for C.B.I. has opposed the third bail application. His contention is that there is no change in circumstance necessitating entertaining the third bail application. 5. I have considered the contentions.

Considering the contentions put forth by counsel for the petitioner, I deem it proper to allow the third bail application.

This third bail application is accordingly allowed and it is directed that accused petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.

Copy of this order be sent to the concerned Court by fax/email today itself with a direction to serve a photostat copy of the same to the petitioner and an additional copy of this order be also sent to the concerned Court by ordinary process.
