Petitioner has filed this third bail application under Section 439 of Cr.P.C.

F.I.R. No.466/2015 was registered at Police Station Kumher, District Bharatpur for offence under Sections 148, 149, 341, 307 & 120-B of I.P.C. and Section 3/25 of Arms Act.

It is contended by counsel for the petitioner that the first bail application was rejected by this Court on 12.12.2017, at that time, it was contended by counsel for the complainant that while in jail, petitioner conspired with the contract killer and got the complainant of this case murdered. It is contended that in that case, charge-sheet has been filed against seven persons. There is no charge whatsoever against the present petitioner. Charge-sheet

was filed on 28.12.2017. it is contended that co-accused Lal Singh and other co-accused have been granted bail by the Court. It is also contended that there are as many as fifty two witnesses, out of which only two witnesses have been examined so far. It is also contended that the petitioner is in custody since 20.11.2017.

Learned Public Prosecutor and counsel for the complainant have opposed the third bail application. Their contention is that petitioner prior to his arrest had threatened the complainant who was later on murdered. It is also contended that, thereafter, relatives of petitioner have been pressing upon the complainantparty to compromise the matter.

I have considered the contentions.

Considering the contentions put forth by counsel for the petitioner, I deem it proper to allow the third bail application.

This third bail application is accordingly allowed and it is directed that accused petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
