Petitioners have filed these bail applications under Section 439 of Cr.P.C.

ECIR No.JPZO/09/2015 was registered by Jaipur Zonal Officer of the Directorate of Enforcement, for offences under Sections 3 and 4 of Prevention of Money Laundering Act, 2002.

It is contended by counsel for the petitioners that the main

accused in this case has been granted bail by this court. Case of the petitioners are on better footing. Property of petitioner Fakir Mohammad worth Rs.18.5 lakh has been attached by the Enforcement Directorate, Jaipur with regard to Ranjeet Singh. It is also contended that the allegation against the petitioners that precedes of crime with regard to petitioner Ranjeet Singh is 4 to 5 lakh. No assets has been attached by the Enforcement Directorate, Jaipur.

Counsel for the respondent-Union of India has contended that against the order granting bail to Jai Prakash and Ashok Kumar, Union of India has already filed Special Leave Petition before the Apex Court which is pending. It is also contended that petitioner-Fakir Mohammad was Tehsildar and petitioner Ranjeet Singh was typist who are all involved in money laundering and the transactions are interconnected, hence, all proceedings are to be taken while deciding the bail applications.

5. I have considered the contentions.

Considering the contentions of counsel for the petitioners also taking note of the fact that bail was granted to the coaccused Jai Prakash on 17.02.2018 and to Ashok Kumar on 31.01.2018 and case of the petitioners are on better footing than that of Jai Prakash and Ashok Kumar. Application seeking cancellation of bail is pending adjudication before the Apex Court for last more than one year. No purpose would be served in keeping the petitioners behind the bars.

These bail applications are accordingly allowed and it is directed that accused petitioners shall be released on bail provided

they furnish a personal bond in the sum of Rs.50,000/- (Rupees

Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
