Petitioner has filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No. 323/2018 registered at Police Station Udyog Nagar, Bharatpur for offence under Sections 193, 195, 365 and 120-B of Indian Penal Code, 1860 and Sections 8/25, 29 of Arms Act, 1959.
Learned counsel for the petitioner has submitted that the petitioner is in custody since 07.11.2018. Challan has already been presented in the Court and conclusion of trial may take time. Co-accused have been granted bail by this Court.
Learned State counsel has opposed the petition.
Although, on the last date, learned counsel for the complainant has submitted that the petitioner is involved in twenty three other criminal cases, but has failed to bring on

record the FIRs to substantiate his argument. Learned State counsel has submitted that as per the factual report dated 17.01.2019, petitioner is involved in four other criminal cases.
Keeping in view the fact that co-accused have been granted bail by this Court and without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to satisfaction of the Trial Court.
