Petitioner has filed this 2nd petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No.33/2018 registered at Police Station Roopwas, District Bharatpur for the offence under Section 302, 394, 201-A, 34 Indian Penal Code, 1860.
Learned counsel for the petitioner has submitted that the petitioner is in custody since 14.01.2018. Petitioner has been falsely involved in this case.
Learned state counsel has opposed the petition and has submitted that the present case relates to murder of Babulal. Case rests on eye-witness account. As per the eye-witnesses, petitioner had inflicted injuries to the deceased. Petitioner is the son-in-law of the deceased. During investigation, rupees

One Lac and Forty Thousand out of the looted amount had been recovered from the petitioner.
Thus, in the present case, prosecution story is that petitioner, who was the son-in-law of the deceased, had inflicted injuries to the deceased. Case rests on eye-witness account. During investigation, rupees One Lac and Forty Thousand had been recovered from the petitioner out of the looted amount.
Keeping in view the seriousness of the allegations levelled against the petitioner, no ground for grant of bail to him is made out.
