1. The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No. 99/16 Registered at Police Station Harnawada Shahji, District Baran for the offences under Sections 147, 148, 302, 341/149 of I.P.C.
2. Counsel for the petitioner submits that the petitioner has been falsely implicated in this matter and he is behind the bars for last about three years.
3. Learned Public Prosecutor has opposed the bail application and submitted that the prosecution witnesses in their statement before the learned trial Court have named the petitioner and it is a case of double murder and as many as 28 witnesses have already been examined and the trial is about to complete.

4. In the facts and circumstances of the present case and looking to the seriousness of the offence(s) alleged against the petitioner, without expressing any opinion on the merits of the case, I am not inclined to release the petitioner on bail under Section 439 Cr.P.C.
5. Hence, the bail application stands dismissed. However the learned trial Court is directed to expedite the trial.
