Learned counsel for the petitioner submits that the suit, wherein impugned order was passed, stands dismissed for nonprosecution wherein a restoration application has been moved. He submits that presently the suit is not pending and, therefore, the present revision petition may be disposed of with liberty to file fresh or with liberty to allow him to restore this petition.
I considered the submissions and find that in the present revision petition, notices have not been issued.
Taking into consideration that the civil suit is no more pending, the present revision petition stands dismissed. The prayer for granting liberty is not made out. However, the petitioner

will be free to take up whatever remedies which are available in law.
