The instant appeal has been filed against the order dated 06.11.2012 passed by learned Additional District Judge, Nimbahera camp Badi Sadri whereby the learned trial court had dismissed the application filed by the appellants under order 39 Rule 1 & 2 CPC.
The counsel for the respondents submits that the main suit has itself been decided by the learned trial court vide order dated 20.11.2017, therefore, the present appeal has become infructuous.
The counsel for the appellants does not dispute the factum of decision of the main suit.
Accordingly, the appeal is dismissed as having become infructuous.
