Mr. Kalyan who is father of the petitioner Bodu Ram is present in person.

He submits that the accused-petitioner is in custody since 03.05.2018. He was on bail during trial and pendency of the appeal. No other case is pending against the petitioner. He further submits that petitioner has been wrongly convicted in the matter without there being any reliable and convincing evidence against him.

On perusal of the record it appears that the accusedpetitioner has been convicted for the offence under Sections 279, 337, 338 and 304-A IPC and awarded maximum sentence of 2 years simple imprisonment for the offence under Section 304-A IPC.

Without commenting upon the merits of the case, I deem it just and proper to suspend the sentence awarded to the accusedpetitioner.

Accordingly, the application for suspension of sentence is allowed and it is ordered that the sentence passed by learned trial court and affirmed by the learned Additional Session Judge No.2, Jaipur, District Jaipur vide his judgment dated 03.05.2018 passed in Criminal Appeal No.19/2018 (64/17) N.C.V. No.78/17 against the accused-petitioner Bodu Ram S/o Kalyan Sahai shall remain suspended till final disposal of present revision petition provided he executes a personal bond in the sum of Rs.50,000/- along with two sureties in the sum of Rs.25,000/- each to the satisfaction of the trial court for his appearance in this Court on 04.07.2018 and, as and when called upon to do so.
