Learned counsel for the applicant-appellant has submitted that applicant-appellant was not apprehended at the spot. In-fact, applicant-appellant has been involved in this case on the basis of the statement of his co-accused Poonaram recorded during investigation. Sentence of convict Poonaram has been suspended by this Court vide order dated 04.09.2017. Applicant-appellant is in custody since 12.01.2012.
Learned State counsel on the other hand, has opposed the petition.
Keeping in view the facts and circumstances of the case, it

would be just and expedient to suspend the sentence of the applicant-appellant during pendency of the appeal.
Accordingly, without expressing any opinion on mertis of the case, application is allowed. Sentence of the applicant-appellant shall remain suspended during the pendency of the appeal. Applicant-appellant be admitted to bail subject to satisfaction of
the Trial Court.
