Heard learned counsel for the accused-appellant and learned Public Prosecutor on the application for suspension of sentence.

Learned counsel submits that the application for suspension of sentence of co-accused Kailash has been accepted by this Court. The arguments therein apply to this case also. The prosecutrix has earlier also lodged similar FIRs against others and settled it in the Court, thus she is in habit to lodge false FIR to extract money. Accordingly, the prayer is to allow the application for suspension of sentence on the same grounds, as given in the

case of co-accused Kailash in DB Criminal Misc. Application for Suspension of Sentence No.308/2018, Kailash Vs. State of Rajasthan through PP , allowed vide order dated 11^th September, 2018.

Learned Public Prosecutor has opposed the application for suspension of sentence, however, it is admitted that similar application has been allowed by this Court. In view of the above, the application for suspension of sentence is allowed on the same grounds, as were given in the case of co-accused Kailash in DB Criminal Misc. Application for Suspension of Sentence No.308/2018.

Accordingly, it is ordered that sentence awarded to accused-appellant namely Kalu Ram S/o Shri Deva Ram by learned Special Court Judge SC/ST (Prevention of Atrocity Cases) Tonk in Sessions Case No.13/2016 shall remain suspended during pendency of the appeal and he be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand only) with one surety in the like amount to the satisfaction of learned trial court with the stipulation that he shall appear before this Court on 22^nd October, 2018 and whenever called upon to do so.
