Heard on the petition to seek first parole under Rule 9 of the Rajasthan Prisoners (Release on Parole) Rules, 1958.

Learned counsel for the petitioner submits that the petitioner is entitled for first parole. It has been denied in reference to the police report though jail conduct of the petitioner is not adverse and otherwise report of Social Welfare Officer is favourable to him. No basis for adverse report by the police exist. The petitioner may accordingly be given benefit of first parole under the Rules of 1958.

Learned counsel for the State-respondents has opposed the petition. He submits that the police report is adverse to the petitioner, thus, benefit of parole was not given.

After considering the rival submissions of the parties and after perusing the record, we find that the petitioner has already undergone the sentence to become entitled for first parole under Rule 9 of the Rules of 1958. His jail conduct has not been reported to be adverse. The Social Welfare Officer has also not given adverse report.

In view of the above, we allow the writ petition. The Superintendent of Central Jail, Ajmer, is directed to release the petitioner namely, Ravindra S/o Ratnaram on first parole for a period of 20 days on furnishing personal bond in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the Superintendent, Central Jail, Ajmer. He shall maintain peace and tranquility during the period of first parole which will include journey period also. In case he fails to surrender on stipulated date, the jail authority shall proceed in accordance with law.
