Land Revenue (Allotment of Land for Agricultural Purposes) Rules, 1970. It was on this premise that the proceedings for cancellation of allotment were initiated by the Additional Collector (IV), Jaipur, who issued notice to the original allottee Mr. Dinesh Khare. When it transpired that he had died, notices were sent to his legal heirs. The Additional Collector (IV), Jaipur, by order dated 06.01.2001 cancelled the allotment of land comprising of khasra nos.10, 29 and 30 of village Deep Pura, Tehsil Amer, District Jaipur, on the premise that the land was situated within the limit of 10 miles from the zero point of Jaipur city. The respondents Vishwanath Poddar, Sunil Kumar Poddar, Smt. Kanta Devi Sarraf and Vishwanath Saraogi, challenged the aforesaid order by filing an appeal, being Appeal No.80/2001, before the Revenue Appellate Authority, Jaipur, who, vide his order dated 20.05.2002, allowed the appeal and restored the allotment of the land on the premise that they bought the land measuring 0.81 hectare, equivalent to 3 bigha and 6 biswa, out of the aforesaid land, as bona-fide purchaser. The Revenue Appellate Authority allowed the appeal on the ground that original allottee Dinesh Khare sold the land in question to one Maliram S/o Govind Verma on 28.07.1976 and the said Maliram sold the said land on 16.09.1981 to one Ali Bux, who later sold this land to the appellants before the Revenue Appellate Authority. The Revenue Appellate Authority also relied on the report of the Patwari, which proved that the distance between the disputed land and the zero point in Jaipur city was 17 kilometers and which was outside the limit of 10 miles given in the Rules while permission of the State Government was required for allotment.
