Learned counsel for the petitioner submits that in identical matters where the petitioner/family member(s) is/are suffering with serious ailments, the State-respondents have accorded posting at the desired station. However, in the case of the petitioner, matter has not been considered sympathetically.

It is further contended that for the present, the petitioner would be satisfied, if the State-respondents are directed to decide the representation of the petitioner, within a time frame in the backdrop of the fact that husband of the petitioner is a chronic kidney disease patient.

Having heard the learned counsel for the petitioner and on perusal of the materials available on record, for the present, the petitioner is required to address a comprehensive representation detailing out her grievances along with documentary evidence as to ailment of her husband for she is treated to be suffered with kidney disease, for sympathetic consideration of her posting at the desired station; within two weeks hereinafter.

In case, a representation is so addressed within the aforesaid period, the State-respondents are directed to consider and decide the same by a reasoned and speaking order taking into consideration the factual matrix as detailed out hereinabove sympathetically. This exercise shall be undertaken by the respondents as expeditiously as possible; preferably within eight weeks from the date of receipt of the representation along with a certified copy of this order.

With the observations and directions, as indicated above, the writ as well as stay application stand disposed off.
