Mr. S.K. Gupta, AAG, submits that identical controversy was considered and disposed off at Principal Seat, Jodhpur, in the case of Poonam Rathore v. State of Rajasthan & Ors.: SBCWP No.3058/2018, decided on 5^th March, 2018; observing thus:

“2. The petitioner qualified her B.A. in 2007 from Karukshetra University having English as Elective Subject. The petitioner having all other qualification participated for the post of Teacher Grade-III (Level II) in pursuance of advertisement dated 11.9.2017 as a Non-TSP candidate. Counsel for the petitioner has shown mark-sheet (Annex.1) on page 17 whereby it

appears that Hindi subject is compulsory whereas English, History and Sanskrit are optional subjects. If English is optional subject, then that entitles petitioner to be considered for appointment on the post of Teacher Grade-III (Level II) in pursuance of advertisement dated 11.9.2017.

Counsel for the respondent is not in a position to refute that English is not optional or equivalent subject.

Thus, the present writ petition is disposed of with a direction to the respondents to thoroughly examine nature of subject English as reflected in mark-sheet and reach to a conclusion and if English subject of petitioner is found to be optional or of equivalent nature, then appropriate appointment shall be given to her in accordance with her own merit within a period of 30 days from today. Such consideration shall be made by a detailed speaking order within a period of 30 days from today. Further, till such consideration of mark-sheet of the petitioner is being made by the respondents, the petitioner shall be permitted to participate in counselling.”

In the instant case at hand, the petitioner acquired educational qualification of Bachelor of Arts from Mahrshi Dayanand University, Rohtak, and has also acquired B.Ed. Degree. He was also successful in RTET Examination.

Having regard to the nature of syllabus of B.A. from Mahrshi Dayanand University, Rohtak; the State-respondents would do the needful to have the option as to its equivalence in order to confer eligibility on the petitioner by constitution of a Committee of Experts.

The respondents would do the needful, as expeditiously as possible; preferably, within two weeks from today.
