Learned counsel Mr. Rajeev Purohit, representing the petitioner, craves liberty to withdraw the instant writ petition seeking leave that the petitioner may be permitted to approach the National Commission for challenging the order passed by the State Commission. He, however, prays that the period during which this writ petition was pending in this court, i.e. from 17.04.2017 till today, may be excluded while counting limitation for filing the appeal before the National Commission. This prayer is not opposed by Mr. Muktesh Maheshwari, learned counsel representing the respondents.
Thus, the writ petition is permitted to be withdrawn. The period aforesaid shall be excluded while calculating limitation for filing the appeal before the National Commission, in case such appeal is preferred within next 30 days. The writ petition is dismissed as withdrawn as above.
