These writ petitions under Article 226 of the Constitution of India have been preferred claiming, in sum and substance, the following reliefs:-

“1.The impugned order dated 12.01.2017 passed by Commissioner, Municipal Council, Balotra may kindly be declared illegal and the same may kindly be quashed and set aside with all consequential benefits.

2. If during pendency of the writ petition, the respondent No.4 proceeds to take possession of the land in question, the same may kindly be restored back in favour of the petitioner with all consequential benefits.

3. Any other appropriate writ, order or direction which this Hon’ble Court may deem just and proper in the facts and circumstances of the case may kindly be passed in favour of the petitioner.

4. Costs of the writ petition may kindly be awarded to the petitioner.”

2. For the sake of convenience, the facts are being taken from the pleadings of the leading case being S.B.Civil Writ Petition No.2471/2017.

The present dispute pertains to a piece of land admeasuring 4 bighas in Khasra No.975/697 situated at Village Jasol, Tehsil Pachpadra, District Barmer, which was under the khatedari of certain persons. The land owners sold the said land to the petitioners, who are said to be the registered purchasers of the land in question by virtue of registered sale deed dated 27.07.2009. The purchasers, including the present petitioners,

constructed a boundary wall and also applied for conversion of the property in question before the competent authority under Section 90(A) of the Rajasthan Land Revenue Act, 1956. The said conversion was allowed and the disputed plots came into existence. The lease-deed in regard to the plot in question was issued in favour of the petitioner on 02.08.2013. Upon certain disputed questions of fact having been raised, the said lease-deed was cancelled on 12.01.2017, without giving any opportunity of hearing to the petitioner.

Learned counsel for the respondents are not in a position to refute the submission made on behalf of the petitioners that the petitioners were not specifically heard on the issue, on the basis of which the aforementioned lease-deed came to be cancelled by the Municipal Council Balotra, District Barmer on 12.01.2017.

In light of the aforesaid submission made by the learned counsel for the parties, the present writ petitions are disposed of with a direction to the respondents to re-visit the impugned order dated 12.01.2017 by giving a proper opportunity of hearing to the petitioners and pass appropriate orders within a period of three months from today strictly in accordance with law. However, it is made clear that the impugned order dated 12.01.2017 shall not come in the way of passing a fresh order by the respondents after proper application of mind and opportunity of hearing to the petitioners. The petitioners shall be free to submit whatever documents and record in their favour. It is needless to say that till the decision is taken by the respondents,
