This writ petition has been filed to seek a direction to remove illegal encroachments in the shape of kiosks and stationary shops in front of the petitioner’s shop.
Those who are having kiosks or stationary shops have not been impleaded as party respondents though effectively, if any

order is passed, it would be against them thus writ petition suffers from non-joinder of necessary party. It is dismissed for the aforesaid reason. The petitioner would, however, be at liberty to pursue the case with the Municipal Council, Jhalawar for the needful.
