Learned counsel for the petitioner is fair enough to state that the issue involved herein has been decided by the larger Bench of this Court in the case of Tara & Ors. Vs. State of Rajasthan & Ors. in DB Civil Special Appeal NO.185/2001 decided on 15th July, 2015. Therein, the question has been answered against the petitioners, though, the matter is pending consideration before the Apex Court,.
In view of above, this writ petition is dismissed and it is ordered to be governed by the judgment in the case of Tara & Ors. (supra). The petitioner would, however, at liberty to seek revival of the writ petition if Special Leave Petition is decided favourably.
