Heard Mr.D.K. Dixit for the appellant and Mr.Sudesh Bansal for the respondent appearing on caveat.
After arguing for a while, counsel in the context of the underlying dispute adjudicated by the two courts below vide their judgments dated 13.05.2010 and 12.10.2017 submitted that the second appeal be disposed of on their consent as under:-
(1) That the appellant will not be dispossessed from the tenanted shop except through due process of law as already held by the courts below in their judgments.
(2) That the respondent-Vyapar Mandal will be free to take recourse to law against the appellant/s for their eviction from the tenanted shop and/or revision of rent in accordance with law.

(3) That the appellant or either of them when the occasion arises will be free to take all lawful defences with regard to the alleged invalidity of the rent note dated 08.08.2000 and the right of the appellant to seek their eviction.
The second appeal stands disposed of accordingly in terms of
the aforesaid agreed order.
