Brief facts, giving rise to the present appeal are that respondents-plaintiffs filed a suit for eviction and recovery of rent against appellants-defendants stating that the suit shop situated in Katla Bazar, Jodhpur was taken on rent by Kishore Chand, husband of appellant No.1/1 and father of appellants No.1/2 to 1/4, on monthly rent of Rs.260/-. Thereafter, Kishore Chand expired on 13.01.1988. The rent was lastly paid on 26.12.1987 and thereafter the defendants have not paid any amount of rent and as such the plaintiffs claimed unpaid rent of 30 months amounting to Rs.7,800/-. Notice terminating tenancy was given on 09.07.1991, however, despite service of notice, neither the defendants paid arrears of rent, nor replied the notice. Written statement to the plaint was filed by the appellants-defendants refuting the averments of plaint in toto. Learned trial Court, on the basis of pleadings of rival parties, framed issues for determination and thereafter the rival parties tendered ocular as well as documentary evidence. Learned trial Court, thereafter, proceeded to decide the issues and, after appreciating the evidence available on record, decreed the suit filed by respondents-plaintiffs directing the defendants to vacate the shop in question within a period of two months.
