State has filed this petition challenging the order dated 25.06.1996, whereby, respondent was ordered to be discharged.
I have heard learned State counsel and have gone through the record available on the file carefully.
In the present case, respondent is a resident of Japan. As per the prosecution case, 20 grams Charas was recovered from the possession of the respondent. Trial Court has ordered the discharge of the respondent on the ground that in the present case, provision under Section 50 of the Narcotic Drugs & Psychotropic Substances Act, 1985 had not been complied with.
In the facts and circumstances of the present case, no ground for interference by this court is made out.
Dismissed.
