Present petition has been filed under Section 482 CrPC to assail the order dated 4.10.2016 passed by Addl. Sessions Judge in Cr. Revision No. 156/2016 preferred by the petitioner.

Counsel for the petitioner contends that petitioner had assailed the order passed by Chief Judicial Magistrate No.2, Jaipur by filing a revision. In the said revision, an application was filed that qua the same incident, two separate FIRs have been lodged – one at Police Station, Jalupura, District Jaipur and another at Police Station, Surajgarh, District Jhunjhunu. The application filed by the petitioner was rejected by the revisional court below by

observing that the incident pertaining to both the FIRs is different and the complainants are also different. To assail the above finding given by the revisional court below whereby the application under Section 186 CrPC was dismissed, no averment has been made that said finding is wrong.

Counsel for the petitioner at this stage has submitted that present petition be disposed of as withdrawn with liberty to the petitioner to file a better petition with better particulars by placing copy of both the FIRs on record.

The present petition is disposed of as withdrawn with liberty, as prayed for.
