This criminal misc. petition under Section 482 Cr.P.C. has been filed by the petitioner with a prayer to direct police authorities to conduct fair investigation into the allegations levelled in the FIR No.78/2017 of Police Station Karda, District Jalore.

It is noticed that earlier also, the petitioner preferred S.B. Criminal Misc. Petition No.3071/2017 with a similar prayer and this Court vide order dated 03.10.2017 disposed of the said petition with liberty to the petitioner to move representation before the Investigating Officer for conducting fair investigation, strictly in accordance with law.

The grievance of the petitioner is this that despite representation to the Superintendent of Police, Jalore as well as to

the Inspector General of Police, Jodhpur Range, the respondentauthorities are not conducting fair investigation into the matter.

After hearing the learned counsel for the petitioner, this Court is of the opinion that if the petitioner is having any grievance regarding the investigation carried out in connection with FIR No.78/2017 of Police Station Karda, District Jalore, then the petitioner is always free to move application before the concerned Magistrate under Section 156 Cr.P.C. in view of the decision of Hon’ble Supreme Court rendered in Sakiri Vasu vs.

State of U.P. [(2008) 2 SCC 409].

It is expected that if any such application under Section 156 Cr.P.C. is moved by the petitioner before the concerned Magistrate, the same shall be considered strictly in accordance with law.

With these observations, this criminal misc. petition is dismissed.

Stay petition also stands dismissed.
