This criminal misc. petition under Section 482 Cr.P.C. has been filed by the petitioner being aggrieved with the order dated 03.04.2018 passed by the Special Judge, SC/ST Act Cases, Chittorgarh (hereinafter to be referred as the ‘court below’), whereby the complaint filed by the petitioner against the respondent Nos.2 to 8 for the offences punishable under Sections

420, 467, 468, 471, 120-B of IPC and under Section 3(X), 3(1) (XI) of SC/ST Act has been dismissed.

The court below has taken into consideration the complaint filed by the petitioner and the police report submitted by the SHO, Police Station Chanderia dated 15.11.2017. The court below has observed that police have concluded that dispute between the petitioner and the respondent No.2 is in relation to some financial transaction, however, the petitioner has filed a complaint against the respondent No.2 and others while narrating some extraordinary facts only with the intention to recover the money from the respondent No.1. The court below has also taken into consideration the statement of the petitioner recorded under Section 200 Cr.P.C. and one witness under Section 202 Cr.P.C and concluded that from the police report as well as the statement of witnesses prima facie no case is made out against the respondent Nos.2 to 8.

Having gone through the impugned order and the material available on record, I do not find any illegality in the order passed by the court below, hence, no interference is called for in this criminal misc. petition and the same is hereby dismissed.
