Manisha Vadhwa Vs State of Raj and Ors.

Learned counsel for the petitioner submits that in FIR No.152/2017 registered at Police Station Mahila Thana, Jaipur City East, (Raj.) for the offences under Sections 498-A, 406, 494, 354 and 506 IPC, no proper and fair investigation is being conducted. He submits that whenever the petitioner approaches the Investigating Officer he avoids to take necessary steps for effective fair investigation.

Having considered the facts mentioned in the petition as also submitted at bar before the Court, this Court feels inclined to allow the petition.

Accordingly, the miscellaneous petition is allowed. It is directed that investigation in FIR No.152/2017, PS Mahila Thana, Jaipur City East, (Raj.) be conducted fairly and partially and effectively under the supervision of DCP, Jaipur East, by an Officer not below the rank of Circle Officer.

This petition stands allowed accordingly.
