Heard learned counsel for the petitioner as well as the learned Public Prosecutor and perused the record of the case.
It is submitted that petitioner has not been identified by the witnesses for offence under Section 302 IPC apart from other offences. It is mainly based on the recovery of the Arm. In view of the above, the petitioner may be granted bail.
Learned Public Prosecutor and learned counsel for the complainant have opposed the bail application. It is submitted that eighteen witnesses have already been examined and after dismissal of the earlier bail application, there is no change in circumstances. Two witnesses have already been dropped by the

prosecution and, now, only three witnesses remain. The trial is likely to conclude thus the bail may not be granted.
After considering the rival submissions made by the learned counsel for the parties, I am not inclined to accept this fourth bail application and accordingly, the same is dismissed.
