The petitioner has been arrested in connection with FIR No. 117/2017 of Police Station Raas, Distt. Pali, for the offence punishable under Sections 341, 323, 325, 342, 394, 397 and 120-B of IPC. He has preferred this 2^nd bail application under Section 439 Cr.P.C after rejection of the first bail application 01.02.2018 by this Court.

Counsel for the petitioner submits that first bail application was not pressed with liberty to file fresh bail application after filing of the challan. Now, challan has been filed by the Police. Counsel for the petitioner further submits that in test identification parade, witnesses has not identified the petitioner. In these circumstances, benefit of bail should be granted to the accused-petitioner as the accused-petitioner is in judicial custody and the trial of the case will take sufficient long time to be concluded.

Learned Public Prosecutor has opposed the bail application.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material on record.

Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioner under Section 439 Cr.P.C.

Accordingly, the 2nd bail application filed under Sec.439 Cr.P.C. is allowed and it is directed that petitioner Prahald Ram S/o Ganesh Ram Soni, be released on bail in connection with FIR No.117/2017 of Police Station Raas, Distt. Pali, provided he executes a personal bond in a sum of Rs.1,00,000/- each with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
