Petitioner has filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No.539/2018 registered at Police Station Hindoli, District Bundi offences under Sections 376(2)(N), 420 and 506 of Indian Penal Code, 1860.

On 14.11.2018 following order was passed by this court:-

“Learned counsel for the petitioner has submitted that the prosecutrix is a married women having three children aged about 19 years, 18 years and 15 years. Infact, the petitioner and the prosecutrix were having physical relations and petitioner has been falsely involved in this case by the prosecutrix after he got married to another lady.

List again on 12.12.2018. In the mean time, in the event of arrest, petitioner be

released on interim bail subject to the satisfaction of the Arresting Officer. Petitioner shall abide by the conditions envisaged under Section 438(2) Cr.P.C."

Learned State counsel who is assisted by counsel for the complainant has opposed the petition but has submitted that in pursuance to the above order, petitioner has joined investigation.

Accordingly, keeping in view the facts and circumstances of the case and the fact that the petitioner has joined investigation, without expressing any opinion on merits of the case, interim bail granted by this Court to the petitioner vide order dated 14.11.2018 is made absolute.

Petition stands disposed of accordingly.
