Rajesh Khotdiya S/O Shri Bhagwan Sahay Khotdiya Vs State of Rajasthan

Petitioner has filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No.86/2018 registered at Police Station Galtagate (Jaipur Metro) offences under Sections 420, 406 of Indian Penal Code, 1860.

On 14.11.2018 following order was passed by this court:-

“Learned counsel for the petitioner has submitted that the dispute between the parties can be said to be purely civil in nature as it relates to execution of agreement to sell.

List again on 12.12.2018. In the meantime, in the event of arrest, petitioner be released on interim bail subject to the satisfaction of the Arresting Officer. Petitioner shall abide by the conditions envisaged under Section 438(2) Code of Criminal Procedure, 1973."

Learned State counsel has submitted that in pursuance to

the above order, petitioner has joined investigation.

Accordingly, keeping in view the facts and circumstances of the case and the fact that the petitioner has joined investigation, without expressing any opinion on merits of the case, interim bail granted by this Court to the petitioner vide order dated 14.11.2018 is made absolute.

Petition stands disposed of accordingly.
