Petitioners have filed this petition under Section 438 Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.P.C.') seeking anticipatory bail in F.I.R. No.34/2018 registered at Police Station Phulera for offence under Sections 342, 323 & 382 Indian Penal Code, 1860.

On 01.11.2018 following order was passed by this

"Learned counsel for the petitioners has submitted that petitioner No.2 principal of the school, whereas, petitioner No.1 is the member of the management. Dispute had arisen after the examination had been conducted. However, now, re-examination has already been conducted and the

students have done well in their examination. Petitioners are ready to join investigation.

List again on 05.12.2018. In the meantime, in the event of arrest, petitioners be released on interim bail subject to the satisfaction of the Arresting Officer. Petitioners shall abide by the conditions envisaged under Section 438(2) Cr.P.C. "

Learned State Counsel has submitted that investigation in the present case is complete and now challan is to be presented in the Court.

Accordingly, this petition is disposed of with a direction that in case petitioners surrender before the Trial Court within ten days from today, they be released on bail subject

to the satisfaction of the said court.
