Petitioners have filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No. 393/2018 registered at Police Station Badi, Dholpur for offence under Sections 143, 323, 341, 504, 336 of Indian Penal Code, 1860 (hereinafter referred as ‘IPC’).

Learned counsel for the petitioners has submitted that it is a case of version and cross-version. Petitioners are not attributed injury falling under Section 307 IPC. However, now parties have

amicably settled their dispute. Petitioners are in custody since 05.10.2018. Presently, petitioners are in judicial custody and are not required for further investigation.

Learned State counsel has opposed the petition.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioners on bail.

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioners be admitted to bail subject to satisfaction of the Trial Court.
