This second bail application under Section 439 Cr.P.C. is laid by petitioner in connection with an FIR, wherein he is charged for offences punishable under Sections 302, 307, 325, 323, 147 & 149.
First bail application on behalf of petitioner was rejected on 01.09.2017.
Learned counsel for the petitioner submits that after rejection of first bail application of petitioner there is substantial change in the circumstances inasmuch as co-accused, viz., Gurpreet Singh S/o Kaku Singh @ Swaroop Singh and Mewa Singh S/o Shri Kashmir Singh have been enlarged on bail by this Court while deciding S.B. Criminal Misc. Bail No.12280/2018 on 06.12.2018 & S.B. Criminal Misc. Bail No.9284/2018 on

26.11.2018, respectively, and the case of present petitioner is not distinguishable from the co-accused.
Learned Public Prosecutor has opposed the second bail application of petitioner.
Having heard learned counsel for the parties and taking into account facts and circumstances of the case, without expressing any opinion on merits of the case, I deem it just and appropriate to grant indulgence to the petitioner by enlarging him on bail.
Accordingly, the second bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Gurlal Singh S/o Balvinder Singh @ Palvinder Singh, arrested in connection with F.I.R. No.78/2017, Police Station Chunawadh, District Sri Ganganagar may be released on bail; provided he furnishes a personal bond of Rs.1,00,000/- with two surety bonds of Rs.50,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
