Petitioners have filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No. 96/2018 registered at Police Station Batoda, District Sawai

Madhopur for offence under Sections 341, 323, 324, 325, 326, 307, 504 and 34 of Indian Penal Code, 1860.

Mr. Habeeb, father of petitioners No.2 and 3 has submitted that the petitioners are in custody for the last more than one month. It is a case of version and cross-version. Challan has already been presented in the Court and conclusion of trial may take time. Petitioner No.1 had also suffered injuries in the occurrence. Injured has been discharged from the hospital.

Mr. Aarif has appeared on behalf of the complainant and has opposed the petition.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioners on bail.

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioners be admitted to bail subject to satisfaction of the Trial Court.
