Petitioner has filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No.16/2018 registered at Police Station Lakheri, District Bundi (Raj.) for offences under Sections 302, 201, 365, 389 and 120-B of Indian Penal Code, 1860.
Learned counsel for the petitioner has submitted that the petitioner is in custody for the last about five months. Petitioner has been falsely involved in this case. Petitioner has completed Engineering course.
Learned State counsel, who is assisted by counsel for the complainant has opposed the petition and has submitted that it is a case of double murder. Skin of the deceased was recovered from

the stones at the spot and Deoxyribonucleic acid test has been conducted with regard to recovered skin with DNA of the son of the deceased. As per the report of the expert, DNA of the skin recovered from the spot matched with the DNA of the son of the deceased. Accused have been subjected to Narco Analysis test and from the said test, it transpired that Hazari Lal used to buy property after consulting the petitioner. Petitioner had illicit relations with daughter-in-law of Hazari Lal and helped her to buy three plots. Ghanshyam alongwith his wife were residing as tenants in the house of Hazari Lal. Ghanshyam knew the family members of Hazari Lal. Hazari Lal told Ghanshyam that he wanted to buy a plot on the basis of ancestral ornaments. Ghanshyam had stolen gold belonging to Hazari Lal. In Jail, Ghanshyam told the petitioner that entire property papers of Hazari Lal had been kept in a safe. It further transpired that the petitioner knew that Hazari Lal and Kailashi Bai had been hidden by co-accused Ghanshyam. Co-accused Ghanshyam knew that the petitioner had the skill to sell the property of Hazari Lal. Ghanshyam had tried to negotiate with the petitioner with regard to property papers of Hazari Lal for Rs.5,00,000/-. The case is still under investigation.
Keeping in view the submissions made by the learned State counsel and facts and circumstances of the present case, no ground for grant of bail to the petitioner is made out.
