The learned Public Prosecutor appearing for the State of Rajasthan has contended that even though, all the witnesses have turned hostile. Injured – Babloo (PW-3) has deposed in a categoric terms against the accused-respondent. State Counsel has further contended that the testimony of Dr. Laxman Gurjar (PW-10) corroborates the ocular version.
After hearing the learned Public Prosecutor appearing for the State of Rajasthan, the present leave to appeal is granted .
The Registry is directed to register and assign number to the proposed appeal against acquittal. The said appeal shall be deemed to have been admitted.
The accused-respondent be served through bailable
warrants.
