The learned counsel for the applicant has placed on record Bye-Laws 30.(3) of Rajasthan Cooperative Societies ByLaws. The learned counsel contends that in consonance thereof, Lallu Ram Mehra P.W.1 working as Cashier was authorized vide Exhibit-P/9 and Exhibit-P/10 to file complaint and prosecute the respondent. The learned counsel for the applicant hence, contends that the finding returned by the trial court that Lallu Ram Mehra P.W.1 was not authorized is factually incorrect.
After hearing the learned counsel for the parties, leave to appeal is granted.
Registry is directed to register and assign number to the proposed appeal and same shall be deemed to have been admitted.
Accused respondent be served through bailable
warrants.
