Matter comes up on an application under Order 41 Rule 19 CPC for restoration of accompanying Civil Misc. Appeal No.2450/2016 which was dismissed for want of prosecution due to non-compliance of peremptory order passed by the Court.
It is stated by learned counsel that he has already filed the requisite notices and earlier notices could not be filed due to bonafide mistake.
The restoration application is supported by an affidavit of the counsel concerned.
