The facts, in brief, giving rise to this appeal are that on fateful day of 11th of February, 2015, when deceased Lucky @ Jitendra Kumar was travelling with three others in Innova Car bearing registration No.RJ-13-UB-2929 driven by Balraj Singh, due to rash and negligent driving of the car by its driver Balraj, it met with an accident at village Inoba 29 BB and collided with a tree. Lucky @ Jitendra Kumar suffered grave and serious injuries and on the spot succumbed to the injuries. One Kulwant Singh also died in the said accident. A case was registered against Balraj for offence under Sections 279, 337, 338 and 304-A IPC and after investigation, he was charge-sheeted for offence under Sections 279, 337 and 304-A IPC. The calamity which occurred in the family of deceased, prompted them to file a claim petition, inter alia, on the ground that at the time of accident deceased Lucky @ Jitendra Kumar was 22 years old. It is also averred in the claim petition that he was in the business of event management, light decoration and DJ, and was approximately earning Rs.50,000/per mensem. The appellant-claimants, worked out compensation under different heads and quantified total amount to the tune of Rs.96 lakhs.
