At the threshold when the matter came up before the Court, while issuing notices, the Court has passed following interim order:-
“Issue notice. Issue notice of stay application. Both the notices are made returnable on 06.10.2018 Meanwhile, if on or before the next date, the plaintiff does not implead Shri Nirmal Shrishrimal as a party respondent, the learned Trial Court shall not decide the TI application No.56/2018 finally.”
It is stated at Bar by learned counsel for respondent-plaintiff that he has already impleaded Shri Srimal as party-respondent in the temporary injunction application and this fact is also noticed by the learned trial Court. In support thereof, certified copy of the order-sheet of learned trial Court dated 15th of September, 2018 is also placed on record. Highlighting all these developments, it is submitted by learned counsel for the respondents in unison that this petition has gone infructuous.
The matter is called out twice but nobody is present for the petitioner. Be that as it may, the fact remains that the stay order has been complied with and the solitary argument before this Court that Shri Srimal was not impleaded as party in the temporary injunction application has been impleaded and the same is no more survives.

In view thereof, due to subsequent developments the petition has gone infructuous and same is, accordingly, dismissed.
