Having heard the counsel for the petitioner and the respondent, in view of the well-considered and detailed findings of the Trial Court in the application under Order 39 Rule 1 and 2 CPC as also the Appellate Court in the Civil Misc. Appeal thereagainst. I am of the considered view that no legal ground whatsoever is made out for this court to exercise its superintending jurisdiction under Article 227 of the Constitution of India thereagainst.
The petition is accordingly dismissed.
