gave an opinion that Bharat Singh was having two fractures on the left Ulna and one fracture of the mid shaft on the right Ulna. The X-ray of the right leg of the injured was forwarded to the radiologist for expert opinion. The radiologist thereafter, gave an opinion dated 09.01.2010 that apart from fractures on the left and right ulna bones of the injured, he was also having a fracture on the end upper of the right tibia bone. All these injuries were opined to be grievous in nature, however, pertinently enough, neither the medical board nor the medical jurist gave any opinion regarding the injuries being life threatening. The investigating officer filed a charge sheet against the accused persons for the offences under Sections 147, 148, 149, 341, 323, 325 and 308 IPC. The trial court, after considering import of the various injury reports and the evidence of prosecution witnesses, proceeded to frame charges against the accused as mentioned above vide order dated 14.10.2014. The prayer of the prosecution to frame charges against the accused for the offence under Section 307 IPC was not accepted. Likewise, prayer of the accused to be discharged from the offence under Section 308 IPC was turned down. Hence, these two revision petitions.
