Learned counsel Shri H.S.. Shrimali states that he may be allowed to withdraw the instant appeal with liberty to prosecute the case on behalf of the complainant in appeal No.56/2017 and Cr. Leave to Appeal No.32/2017 submitted by the State of Rajasthan against the impugned judgment rendered by the trial court in favour of the accused.

In this view of the matter and keeping in view the Division Bench’s Judgment of this Court rendered in the case of Ramvati vs. State of Rajasthan (D.B. Criminal Leave to Appeal No.61/2017) decided on 03.03.2017 , the instant appeal preferred by the complainant is allowed to be withdrawn since the same is not maintainable. Shri Shrimali is allowed to represent the complainant in the above mentioned leave to appeal and appeal filed by the State of Rajasthan against the impugned judgment.

Thus, the instant appeal is dismissed as withdrawn with liberty prayed for.
