Petitioner has filed this second bail application under Section 439 of Cr.P.C.

F.I.R. No.76/2015 was registered at Police Station Ramganj, Jaipur for offence under Sections 420, 406, 120-B of I.P.C.

It is contended by counsel for the petitioner that the matter is more of civil dispute. The allegation is that the petitioner has received some precious/semi precious stones and the amount was due towards the complainant.

It is contended that as many as four witnesses have been examined but they have dispute against the present petitioner. It is also contended that first bail application was rejected on the ground that the petitioner has concealed the fact of pendency of

cases.

Learned Public Prosecutor has opposed the second bail application.

I have considered the contentions.

Considering the contentions put forth by counsel for the petitioner, I deem it proper to allow the second bail application.

This second bail application is accordingly allowed and it is directed that accused petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when
