On consideration of submissions made on behalf of the respective parties and the material made available for my perusal as well as the evidence collected during investigation which has been placed on record by way of copy of the charge-sheet and more particularly looking to the statements of the material prosecution witnesses recorded during the course of trial, but without expressing any final opinion on the merit and demerit of the case, I am inclined to enlarge the petitioner on bail under Section 439 Cr.P.C.
Consequently, the second bail application filed under Section 439 Cr.P.C. is allowed.
It is ordered that the accused-petitioner-Sunil Kunal son of Shri Sitaram, in FIR No. 10/2016, registered at Police Station Kardhani, District Jaipur, shall be released on bail; provided he furnishes a personal bond of Rs. 50,000/- (Rupees Fifty thousand only) and two surety bonds of Rs.25,000/- (Rupees Twenty Five thousand only) each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.

However, as PW2-Shri Yogesh Arora has resiled from his examination-in-chief during the course of cross-examination subsequently held, it is expected from the trial Court to initiate appropriate proceeding, if any, against him in this regard.
