Mansur Khan Vs State and Ors.

Learned counsel for the petitioner states that the controvesy involved in the instant writ petition is squarely covered by an order passed by a Coordinate Bench of this Court in a bunch of writ petitions led by S.B. Civil Writ Petition No. 3141/2015 (Jagdish Chandra Khatik & Ors. Vs. State Of Rajasthan & Ors.) which came to be decided on 03.04.2015, in the light of the judgment dated 29.07.2009 rendered in Jagdish Bhanoda Vs. State Of Rajasthan & Ors. (S.B. Civil Writ Petition No.773/2009) which has subsequently been affirmed by the Hon'ble Supreme Court.

Learned counsel appearing on behalf of respondents does not dispute this position.

Accordingly, the instant writ petition is disposed of requiring the petitioner to submit a detailed representation to the appropriate authority for adjudication of his grievance along with a copy of this order. Upon filing of such representation, the appropriate authority shall objectively consider and decide the same in light of the ratio of the judgment rendered by this Court in Jagdish Bhanoda (Supra) by passing a reasoned and speaking

order within a period of eight weeks from the date of receipt of such representation. In case the petitioner is found entitled to any monetary benefit, the same shall be released to him immediately. In case, any grievance, survives to the petitioner, he shall be at liberty to approach this Court.

With these directions, the above noted writ petition stands disposed of.
