Single Judge at Principal Seat at Jodhpur on 08.09.2016 had issued notice to the respondents and ordered that petitioner therein shall be permitted to appear in the interview before the Rajasthan Public Service Commission provisionally. Counsel for the petitioner submits that qua the controversy raised, the Rajasthan Public Service Commission filed an appeal and Division Bench at the Principal Seat in D.B. Civil Special Appeal(W) No.735/2016 had stayed the operation of the order passed by the Single Judge. Counsel for the petitioner contends that since the Principal Seat at Jodhpur is seized of the controversy, hearing of the present petition be deferred.

Shri Kumawat appearing for the Rajasthan Public Service Commission has submitted that the respondent Rajasthan Public Service Commission shall abide by the outcome of litigation in Civil Writ Petition No.7673/2016- Satish Kumar Sharma Vs. The Secretary, RPSC, Ajmer and of the appeal filed i.e. The Rajasthan Public Service Commission Vs. Satish Kumar Sharma, D.B. Civil Special Appeal(W) No.735/2016. It is further submitted that in case the writ petition filed by Satish Kumar Sharma is allowed, similar benefits shall flow to the petitioner.

Prayer made by Shri Kumawat is just and appropriate. Consequently, the present writ petition is disposed of by ordering that respondent Rajasthan Public Service Commission shall abide by the outcome of the writ petition filed by similarly situated candidate Satish Kumar Sharma at Principal Seat at Jodhpur. The particulars of the writ petition and appeal have already been noticed above.
